Welcome to Viska AI, an AI-powered clinical decision support platform for transplantation medicine. These Terms of Service ("Terms") govern your access to and use of Viska AI’s services, software, and website at viska.ai (“Platform”), provided by Viska AI AB ("Viska", "we", "our", or "us").

By using the Platform, you ("User", "you") agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Platform.

‍1. Scope of Services
‍Viska AI provides intelligent decision support tools, including:

A Knowledge Acquisition Tool for transplant-related research.
A Research Application for transplant-related research.
Clinical Decision Support (CDS) modules tailored to various types of transplantation (currently in research or evaluation stages).

These tools are intended to support clinicians in research and professional contexts by providing evidence-based insights, not to replace professional medical judgment. Viska AI is under continuous development and will progressively improve its applications to enhance clinical outcomes, strengthen data security, and maintain regulatory compliance in line with evolving standards.

‍2. Eligibility and Intended Use
‍Viska AI is intended for use by:

Licensed medical professionals,
Authorized clinical institutions,
Research organizations and diagnostics or pharmaceutical companies engaged in research or clinical development.

You must be legally authorized to act on behalf of a healthcare institution or have appropriate professional credentials. This is not a tool for patient self-diagnosis or direct consumer use.

3. Data Usage and Privacy
‍Viska AI complies with GDPR, HIPAA, and other applicable regulations. Use of the platform may involve the processing of anonymized or pseudonymized health data. Users are responsible for ensuring that:

Data uploaded or accessed complies with local and institutional data protection standards.
No personally identifiable patient data is shared without appropriate consent or legal basis.

Important: Do not upload any personal or patient information to the platform. Viska AI may use online services such as ChatGPT to process queries, and these are not designed for handling identifiable health information. ‍4. Clinical Responsibility Disclaimer
‍The Viska AI platform provides clinical decision support, not medical advice. All recommendations are based on algorithms, real-world data, and medical literature, but:

Final responsibility lies with the licensed medical professional.
Viska AI is not liable for clinical decisions or patient outcomes based on use of the Platform. The platform’s insights are intended to support, but not substitute, expert clinical evaluation and should be treated as exploratory unless validated through certified clinical processes.

5. Intellectual Property
‍All content, models, and software available on viska.ai are the intellectual property of Viska AI AB and protected by applicable copyright and patent laws. You may not:

Copy, reverse engineer, or reproduce the platform or its outputs.
Use the service for competitive analysis or commercial redistribution.

6. Subscription and Licensing
‍Access to Viska AI is provided under institutional licenses, with pricing based on institution size, transplant volume, and scope of use. Unauthorized sharing of accounts or data is prohibited.

If you are using Viska under a trial, the license is limited to evaluation purposes and expires after the agreed period unless otherwise extended. Trial or evaluation licenses are for non-clinical research or testing purposes only and must not be used for real-time patient care decisions. Any such use is strictly prohibited and may constitute a violation of medical device regulations.

Usage of the platform must remain within the limits of normal user behavior as defined by Viska AI. The maximum allowed usage volume will be determined in relation to the subscribed plan. Excessive use, automated querying, scraping, or use of bots or scripts to access or interact with the platform is strictly prohibited. Accounts found to engage in such activity may be suspended or terminated without prior notice at the sole discretion of Viska AI.

‍7. Availability and Support
‍Viska AI is delivered as a Platform-as-a-Service (PaaS) and may experience occasional downtime for maintenance, updates, or due to third-party outages. We commit to reasonable uptime standards and provide support during business hours via support@viska.ai.

‍8. Regulatory Status
‍Viska AI is currently under development as an analytical and decision support tool. It is not yet certified or approved as a Software as a Medical Device (SaMD) under EU IVDR, U.S. FDA, or other jurisdictional frameworks.

The platform is intended for research and professional use only, and its outputs are not to be used as the sole basis for clinical decisions. Viska AI’s future development aims to align with applicable regulatory standards, and any transition to certified medical device status will be clearly communicated to all users.

Users are responsible for ensuring that use of the platform complies with local laws and institutional requirements.

‍9. Termination
‍We reserve the right to suspend or terminate your access:

- For breach of these Terms,
- If required by law or regulatory action,
- Upon expiration or non-renewal of licensing agreements.

10. Limitation of Liability
‍To the extent permitted by law, Viska AI AB is not liable for:

Any indirect, incidental, or consequential damages,
Loss of data, profits, or reputation,
Clinical or treatment decisions made using the Platform.

Our maximum liability is limited to the amount paid for access to the Platform within the prior 12 months. Viska AI makes no express or implied warranties regarding the platform’s fitness for any certified medical purpose or regulatory compliance unless and until formally authorized by the relevant authority.

‍11. Modifications
‍We may update these Terms from time to time to reflect changes in our services or legal obligations. Users will be notified of material changes. Continued use constitutes acceptance of the updated Terms.

‍12. Governing Law
‍These Terms are governed by the laws of Sweden, without regard to conflict of laws principles. Disputes shall be resolved in Stockholm District Court unless otherwise required by applicable law.
